The Information Utility Data Services is an electronic repository for financial data uniquely designed to support transparency and early resolution in the credit ecosystem. It plays a pivotal role in storing and verifying information related to debt and defaults.
Creditors submit debt and default data to the IU for verification by debtors and guarantors. The authenticated Record of Default (RoD) aids the Adjudicating Authority in identifying defaults during insolvency proceedings.
By enabling early detection of financial distress, the IU helps preserve asset value and ensures quicker resolution. It serves both regulated and non-regulated entities across the financial ecosystem.
Financial Creditor (FC):
Under Section 7 of the Insolvency and Bankruptcy Code (IBC), 2016, financial creditors are empowered to initiate the Corporate Insolvency Resolution Process (CIRP) against corporate debtors in default. Leveraging IU services enhances transparency, speeds up processes, and strengthens legal compliance.

Operational Creditor (OC):
An OC under the Insolvency and Bankruptcy Code (IBC), 2016, is defined as a person to whom an operational debt is owed.
An operational creditor may file an application before the Adjudicating Authority for initiating CIRP if, after the expiry of ten days from the delivery of a demand notice or invoice under Section 8, the corporate debtor has not paid the unpaid operational debt or has not sent a notice of dispute.

Corporate Debtors/Guarantors/Co-obligants:
The IU is required to authenticate information received from creditors with all parties to the debt like the corporate debtor, guarantor, and co-obligant before storage of such information. Authentication invitations are sent to the email IDs provided by the creditor, registered with the MCA, and registered on the platform, with up to three reminders issued at seven-day intervals for response from the debtor.

An Insolvency Professional under the IBC is a qualified individual/entity registered with the IBBI, responsible for managing and overseeing insolvency and bankruptcy proceedings in India. Their role is crucial in ensuring the effective and fair resolution of distressed entities.

NeSL- IU (Information Utility) significantly enhances the functioning of Adjudicating Authorities by providing access to verified financial information, streamlining processes, ensuring data integrity, and facilitating dispute resolution.

Insolvency & Bankruptcy Board of India (IBBI):
NeSL-IU is an Information Utility (IU) registered with and regulated by the Insolvency and Bankruptcy Board of India (IBBI) under Section 210 of the Insolvency and Bankruptcy Code, 2016 (IBC) and the Insolvency and Bankruptcy Board of India (Information Utilities) Regulations, 2017.
NeSL-IU plays a pivotal role in supporting the adjudicating authorities and IBBI by providing financial information, facilitating regulatory reporting, strengthening the regulatory framework, aiding in policy formulation, and enhancing stakeholder confidence in the insolvency ecosystem.

Digital Document Execution (DDE)
DDE is a mode of paperless execution and storage of financial contracts, resulting in superior enforcement and enhancing the ‘Ease of Doing Business,’ especially in times when quick financing is the need of the hour for businesses.
This concept was formulated under the guidance of the Ministry of Finance and the IBBI for NeSL to serve the financial sector by facilitating the dematerialization of financial contracts.

Electronic Bank Guarantee (e-BG)
An Electronic Bank Guarantee (e-BG) eliminates the physical documentation usually associated with the issuance of a BG. The digital steps in an e-BG include BG application, preview and confirmation, paperless e-stamping, e-signing, hosting of the final electronic BG on the NeSL portal, and intimation of the final BG to the beneficiary.
The beneficiary can view the final digital BG on the NeSL portal immediately upon issuance. An e-BG also eliminates the need for separate authentication from the issuing bank.

A Record of Default (RoD) is a digitally authenticated document maintained by an Information Utility (IU), such as NeSL (National E-Governance Services Ltd.), confirming that a borrower has defaulted on a financial obligation.

An Information Utility (IU) is registered with the Insolvency & Bankruptcy Board of India (IBBI) under the IBC, 2016, and functions under the IBBI (Information Utilities) Regulations, 2017, as well as the Guidelines for Technical Standards. It collects, stores, and maintains an electronic database of financial information and provides authentic data related to debt and defaults to eliminate delays and disputes regarding claims and defaults.
IUs play a crucial role in facilitating the insolvency resolution process by providing accurate and undisputed information to stakeholders, including Resolution Professionals, creditors, and the Adjudicating Authority.
An Information Utility is mandated to provide the following core services:
(a) acceptance of electronic submission of financial information;
(b) safe and accurate recording of financial information;
(c) authentication and verification of financial information; and
(d) providing access to stored information to specified persons.
National E-Governance Services Ltd. (NeSL) is an Information Utility (IU) registered with the Insolvency & Bankruptcy Board of India (IBBI) under the IBC, 2016. It acts as an electronic repository of financial information for both financial creditors and operational creditors.
